In accordance with data protection legislation, and any other relevant and currently applicable legislation, the user is informed that the personal data provided, where applicable, will be incorporated into an automatic file, which will be used solely for the purposes described in the relevant form, pre-contract or offer. 

Customer data  

In the event that you have provided your data as a contact person of a customer or supplier company or as an individual entrepreneur, either as a customer or as a supplier of Viva In Vitro, we inform you that Viva In Vitro will use the data exclusively for the maintenance of the contractual relationship and will not pass them on to third parties, unless such transfer of data is necessary in compliance with the contractual relationship with the owner of the data or his company. The data provided will be retained for as long as the contractual relationship is maintained or for the years necessary to comply with legal obligations. Furthermore, we inform you that as a customer or supplier of Viva In Vitro, Viva In Vitro may send you commercial information through the means you have provided, including e-mail, based on the Legitimate Interest regulated by the General Data Protection Regulation. 

We also inform you that Viva In Vitro may use your personal data for training and parameterisation purposes, when the service provided to the client so requires. 

Research and clinical trial data 

In the context of our research activities and clinical trials, we process personal data of participants with the aim of advancing scientific knowledge and improving public health. The key aspects related to the processing of this data are detailed below: 

– Purpose of Processing: The re-use of encrypted personal data for research purposes is considered lawful and compatible when it has been obtained with consent for a specific purpose. The data will be used for purposes or areas of research related to the area of the initial study, in accordance with Article 13 of the GDPR.  Viva In Vitro will not have access to data that allows identification in this context. 

– Types of Data Collected: In the context of research and clinical trials, we may collect: 

  1. Medical and health information (medical history, test results).
  2. Demographic data (age, gender) 
  3. Information on participation in the study (informed consent).

– Legal Basis for Processing: The processing of personal data for scientific research purposes will be carried out provided that appropriate safeguards for the rights and freedoms of data subjects have been assessed and recognised ethical standards are respected. This includes the possibility of processing operations that do not allow data subjects to be identified, such as anonymisation or pseudonymisation of data. 

Data relating to commercial contacts and requests for information. 

We inform you that Viva In Vitro uses the contact details of client companies or potential clients to send information that may be considered to be of a commercial nature. In this sense, the recipients of the information may be clients, potential clients who have been previously contacted by Viva In Vitro, people who contact Viva In Vitro through the contact form, as well as people who have subscribed through the corresponding form. In the event that a data subject is receiving this type of information, he/she will be in one of the cases listed. The information sent by Viva In Vitro is understood to be that which may be of interest to the recipient and at all times is related to the products or services of Viva In Vitro and in which the data subject has shown some kind of interest.  

The legal basis for the lawfulness of data processing for this purpose is none other than the legitimate interest of Viva In Vitro. This legitimate interest is weighted at to keep you informed at all times of the possibility of unsubscribing from these mailings, as these are contact details of legal persons, so that the purpose pursued by Viva In Vitro will always be business, by sending information always related to the products and services of Viva In Vitro, in which the holder was interested.

Viva In Vitro will keep your data for as long as you do not object to its processing.  

Data relating to suppliers  

In the event that you have provided your data as a contact person of a supplier company or as an individual entrepreneur, we inform you that Viva In Vitro will use the data exclusively for the maintenance of the contractual relationship and will not pass them on to third parties, unless such transfer of data is necessary in compliance with the contractual relationship with the data owner or his company. The data provided will be retained for as long as the contractual relationship is maintained or for the years necessary to comply with legal obligations. The legitimate basis for the processing is the fulfilment of the contractual relationship. 

Data relating to candidates 

In the event that you have provided your data to Viva In Vitro as a potential candidate to form part of the same, we inform you that Viva In Vitro will use the data exclusively to manage your application for any vacancies that may exist and will not pass them on to third parties. The data provided will be kept for a maximum period of two years. The legitimate basis is your consent in sending your CV.  

Exercising rights common to all personal data 

The owner of the data has the right to obtain confirmation as to whether we at Viva In Vitro are processing their personal data, and therefore has the right to access their personal data, rectify inaccurate data or request its deletion when the data is no longer necessary, as well as to oppose the processing of their data for any of the purposes set out herein, such as for example for sending commercial information.

In addition, if deemed necessary, the data owner may go to the corresponding supervisory authority to lodge the complaints that he/she considers appropriate, in the case of being located in Spain, to the Spanish Data Protection Agency (Agencia Española de Protección de Datos). 

 

Accuracy of data and updating 

Viva In Vitro presumes that the personal data provided through the different channels and media are truthful, that they are provided directly by the owner, that the owner is who he/she says he/she is, that the data are up to date, that the affected/interested party will communicate any modification of his/her data as soon as it occurs. 

Duty of secrecy 

The persons involved in the processing of data concerning natural persons and who directly or indirectly access the files shall at all times observe secrecy with regard to the personal data that they become aware of in the course of their work. The Duty of Secrecy constitutes an obligation for Viva In Vitro, the members of the management and governing bodies, the persons contracted under labour law, the professionals providing services contracted under commercial law. It is also an obligation for suppliers of goods and services and their employees, the Data Processors and their employees, those subcontracted by the Data Processor and their employees. The obligation of secrecy shall survive the termination of the employment or commercial relationship established with Viva In Vitro, the Data Controller, as well as after the expiry of the employment or commercial contracts, etc., that link the employees and/or professionals with the Data Processor and the suppliers that provide goods or services to Viva In Vitro. 

Recommendation of websites/pages 

Viva In Vitro, when recommending or linking to websites/pages, considers them to be of interest to the user. Viva In Vitro has no obligation to monitor the websites/pages it links to or recommends. They have been created by legal entities, individuals or unincorporated entities outside of Viva In Vitro. Viva In Vitro does not intervene in their management, finance them, decide on their content, or manage or participate in the services provided by the linked or recommended websites/pages. Viva In Vitro will cancel any link and will refrain from recommending the website/page when it has irrefutable evidence that it and/or the services it provides are illicit or harm the property or rights of third parties liable for compensation.
